Trademark Registration

A trademark is an intellectual property which may consist of words, name, symbol, slogans, logo, numbers, photograph, sound, smell, colour combination or graphics. It helps in identifying the products or services of an individual or business entity from the same goods and services provided by other businesses. Most businesses look for the registration of a logo or name only. A registered trademark is an intangible asset for the business which acts as a protective cover for the distinct identity of the logo or brand.

In India, trademarks are registered by the Controller General of Patents, Designs and Trademarks, Ministry of Industries and Commerce, Government of India. The trademarks are registered under the Trademark Act,1999. Once a trademark is registered, you can use an R symbol with it and it will be valid for 10 years from the date of registration. You can easily get a trademark within 3 days but to get an R, it can take up to 2 years.

Advantages Of Trademark Registration

The advantages of registering a trademark are as follows :

  1. Unique Identity: Customers identify a particular product or service with the brand name or logo. Registering a trademark ensures that competitors will not use it and it remains an exclusive property of the business.
  2. Legal Protection: A registered trademark owner can sue a third party for infringement, i.e., using a trademark without the owner’s permission.
  3. Great Business Opportunity: A product or service sold under a registered trademark helps in building trust, safety and goodwill in the minds of customers.
  4. Global Filing of Trademark: A trademark registered and filed in India is permitted to be filed in other countries outside India as well. Foreigners can also get a trademark registered and filed in India.
  5. Creation of an Intangible Asset: A registered trademark becomes an intangible asset which can be traded, franchised, distributed or commercially contracted. It is highly beneficial for a company or an individual proprietor.
  6. Applying the Registered Symbol: The company can use the registered symbol (R) once the trademark is filed. It serves as an evidence of the fact that the trademark is registered and is the exclusive property of the company.
